All Factors Considered

There is a general reservation about utilizing the hard sciences to influence legal decisions.  One consistent point of opposition is the inequity that can result from applying rigid, artificial rules to persistently human fact patterns.  Thus, in majority, the law has worked to establish standards, often guided by rules, as a flexible alternative.  The negligence formula outlined by Judge Learned Hand is a rule that has been utilized to establish a duty of care in tort law.  As noted below, the variables within the Hand formula have been applied liberally to account for a wide range of public policy considerations that often modify the underlying mathematical logic.  This post is a placeholder for a future essay advocating that the objectivity and value of the Hand formula can be increased by utilizing hard science to calculate the variables and social science to modify the result.

Definitive Snow Cones

The law has a way of making relatively simple concepts uniquely difficult to grasp at first glance.  Analyzing the jurisdiction of federal courts, i.e., their right and power to apply the law, is of this type.  After a complete review, it seems that a definitive illustration is in order to capture the moment.  The following is presented for your consideration.  It presents the relative factors that the courts must consider before deciding, with increasing finality, that they have the power make a decision.

Life Cycle Homes, D001

First development based upon LC002 design.  The goal of this plan is to exceed the value of an apartment by providing landscaped views and quiet private spaces; design features include:  common space water features, fully secured perimeter, and private backyards.  As shown, there are 14 secured parking stalls and 3 gated entrance points around the perimeter.  Most parking stalls lead directly to the home.  Here is a rendering of the design:

All physical features of the development will be complimented by integrated technologies for communications, energy, and security to reduce operating costs for the residents.  Creation of a shared geothermal loop may be possible, depending upon the market characteristics of the final location.  Dimensions of this plan are 258' x 104' - equivalent to 3-4 residential lots.

Working Definitions

The One Number Theory is a means of calculating the value we create from our choices over time. It supports transformation of the continual flow of data and information we automatically produce into a instantaneous measure of performance that we can contrast internally, against our goals, and externally, against a statistically equivalent peer group. The theory concludes that life momentum may be represented by a one number measure of change - theta - that is calculated as a visual contrast of positives and negatives over time (see Value and Anytime (t)). The theory is based upon a wide range of mathematical, philosophical, and physical concepts; many of which have been provided below as working definitions of its contextual framework.

Amplitude (noun)
1.  The measure of something's size, especially in terms of width or breadth; largeness, magnitude; 2. (mathematics) The maximum absolute value of the vertical component of a curve or function, especially one that is periodic; 3. (physics) The maximum absolute value of some quantity that varies.

Comprehensivity (noun)

Theta Over Life (L)

Life is a converging series of divergent paths. We progress through each to reach new decision points and new pathways of redefined focus. Time is our measure of progress and each second defines a period of reference.  The One Number Theory is a means of calculating the value created within each period.  In practice, it provides a mathematical value system we can use to understand the present and define the future.

Theta is the One Number.  It represents a measure of momentum within a value system.  Calculation is based upon a balance of performance in any ten prioritized categories of value that geometrically define instantaneous momentum within the value system.   The theory provides the model and all categories and performance values are user defined within it.  Each category value is an iterated ratio of user performance against user defined goals, and user performance against a statistically equivalent peer group with the same goals.  The end result is a universal mathematical model for an individual value system that adds relativity to present and future actions.  The following graphic represents the value system defined by the example data set provided in ML07192009, as follows:

The categories in each of the ten columns - in this set, seven positive and three negative - and priority order of their ranking are user defined with all negatives placed in higher priority to all positives (starting with the highest positive to the left of the lowest negative). As shown above, the point of evaluation always creates a 90 degree angle with the axis of time (x-axis), thus creating an equivalent calculation for the vertical measure (y-axis) as the tangent of theta multiplied by time. The One Number Theory states that this vertical measure is equivalent to the value (V) created by the user over time (t) with a life momentum of theta (Θ); as an equation - V = tan(Θ) * t. This connection, albeit simple in this form, is the basis of the theory and the proposed mathematical link between how we life our lives (Θ) and what we produce from the effort (V) over time (t).

Theta is a scalable measure. It may be calculated as a single number evaluation for an entire 100 year life, or as a single number summation of 100 annual calculations. The merit and purpose of the measure is dependent upon the goals of the user and the honesty in the data,  however, the geometry is the same over any period of time. As user data accumulates, it will become more valuable by enabling new forms of valuation and peer comparison. On the point of honesty, each data set is intended for implementation with anonymous, single party access to maximize its value by encouraging full disclosure and enabling unrestricted peer comparison.  
To provide an illustration, the following value system was created by expanding the example data set from ML07192009 over 60 years with 30 years of historical data and 30 years of forward projections:  

As shown, this value model enables a comparison of two scenarios.  The divergent point between the scenario's occurs at T3 (age 30) and may be considered the present condition.  The first scenario includes an escalation of positives to meet future goals and continuance of negatives at present levels, the second scenario is an escalation of positives to meet future goals against negatives that are transformed over time into future positives.  The resulting conclusion is that an exponential (401%) increase in value created by a focused effort to transform the three targeted negatives into future positives, i.e., by a focused effort to improve theta over time. The calculations to support this conclusion are as follows: 

What the numbers verify, and the graphics project, is that simply increasing positives and ignoring negatives will not enable a transformational change, that is, negatives are and will always be inherently limiting factors until overcome - a fact proven by countless social proofs, for example, Sharpe James, Rod Blagojevich, and complimentary philosophical statements such as The Art of Subtraction and Running With Parachutes.  Working under this proof, we can utilize theta as a means to balance time across priority goals that are most likely to drive us toward the highest representation of ourselves.

Simply put, the One Number Theory is a means of calculating the value we create from our choices over time. It has been derived as the foundation for a mathematical philosophy of dynamic self evaluation. As demonstrated above, application of the theory transforms the data streams of choice into a value model that we can use to guide the philosophy behind our actions towards the highest possible result. It is a practice made possible by technology and written in compliment to the future we define from its influence.

Life Cycle Homes, LC002

Second in a series of seven concept homes to be developed under the "Life Cycle Homes" brand of minimalist designs with ultra low operating costs and a 100 year design life. This plan - LC002 - is a 600 sqft residence that offers a king size bed, 10.5' ceilings, and built in storage. Targeted cost for a completed structure is $60,000 or $100.00 per square foot. The end goal is a model for urban infill projects that creates social value by maximizing the density of existing developments. This goal reinforces sustainable design principles by expanding the local tax base, and therefore local resources, at little or no additional public works expense.

The mission of PressedImages Design is to deliver a mass customizable line of business wear that reinforces the form and spirit of the owner.  These three shirt designs are inspired by the dual roles of work and play that we each live everyday.  They share a common form that works the fabric to reinforce the strongest features of the male form.  The ultimate cut, details, and finish of shirt will be defined to exude professionalism whilst under jacket and tasteful individualism in the open.

A Tribute to Action

Among my favorite wonders of reading is the ongoing discovery that bright minds from unrelated experiences, geographies, and millennia can so rightly express modern challenges. Thus, upon that reflection, do I post the following excerpt from Thoreau's "Civil Disobedience" in honor of a moral conviction to, at the very least, voice perceived injustice even if no positive benefit can be conferred from the action.

From Henry David Thoreau's Essay: Civil Disobedience

"It is not a man's duty, as a matter of course, to devote himself to the eradication of any, even the most enormous wrong; he may still properly have other concerns to engage him; but it is his duty, at least, to wash his hands of it, and, if he gives it no thought longer, not to give it practically his support. If I devote myself to other pursuits and contemplations, I must first see, at least, that I do not pursue them sitting upon another man's shoulders. I must get off him first, that he may pursue his contemplations too. See what gross inconsistency is tolerated. I have heard some of my townsmen say, "I should like to have them order me out to help put down an insurrection of the slaves, or to march to Mexico; — see if I would go"; and yet these very men have each, directly by their allegiance, and so indirectly, at least, by their money, furnished a substitute.
